Terms of Use

These Terms of Use ("Terms") govern your use of the Swimiss website (the "Site"), operated by Swimiss Academy ("Swimiss", "we", "our", "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. These Terms and others

These Terms cover general use of the Site. Some activities have their own terms that apply in addition to these:

2. Using the Site

You may browse the Site, read our content, and use its features for your own personal, non commercial use. You agree to use the Site only in lawful ways and not in a manner that harms Swimiss, our users, or anyone else.

3. Your account

  • You agree to provide accurate information and to keep it current.
  • You are responsible for keeping your sign in secure and for activity that happens under your account.
  • Tell us promptly at support@swimiss.com.my if you suspect unauthorised access.

4. Shop and bookings

Product listings, prices, and availability shown on the Site are an invitation to order, not a binding offer. An order is accepted as set out in the Terms of Sale. Course and session information on the Site is provided to help you choose. The actual training is delivered by Swimiss instructors at designated venues, and is subject to the terms agreed at enrollment.

5. Acceptable use

You agree not to:

  • Use the Site for any unlawful purpose or in breach of these Terms.
  • Impersonate any person or misrepresent your identity or affiliation.
  • Attempt to access another user's account, scrape the Site, or reverse engineer it, except to the extent allowed by law.
  • Interfere with the Site or our servers, introduce malware, or probe for vulnerabilities outside a coordinated disclosure arrangement.
  • Use the Site to harass, abuse, or harm any instructor, student, or staff member.

6. Intellectual property

The content on the Site, including text, images, course descriptions, branding, and layout, is owned by Swimiss or licensed to us. You may view and share links to it for personal, non commercial use. You may not copy, republish, or use it commercially without our written permission.

7. Links to other sites

The Site links to services we do not control, such as our social media pages, WhatsApp, maps, and our payment provider. We are not responsible for the content or practices of those services. Their own terms and privacy notices apply when you use them.

8. Disclaimers

The Site is provided on an "as is" and "as available" basis. We aim to keep its content accurate and the Site available, but we do not promise that it is error free or uninterrupted. Information about freediving and training on the Site is general in nature. It is not medical advice and is not a substitute for proper instruction and supervision in the water.

9. Limitation of liability

To the maximum extent permitted by law, Swimiss will not be liable for any indirect, incidental, special, or consequential loss arising from your use of the Site. Nothing in these Terms excludes liability that cannot be excluded under Malaysian law, including your mandatory consumer protection rights. Liability for shop purchases is addressed in the Terms of Sale.

10. Privacy

Your use of the Site is also governed by our Privacy Policy. Please read it.

11. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page shows the latest version. Continued use of the Site after a change takes effect means you accept the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site, subject to any mandatory consumer protection rights that apply where you live.
