Terms of Sale

These Terms of Sale ("Terms") govern your purchase of products from the Swimiss online shop operated by Swimiss Academy ("Swimiss", "we", "our", "us"). By placing an order you agree to these Terms. Please read them before you check out.

These Terms apply only to shop purchases. Use of the Swimiss mobile app is governed by the Mobile App Terms of Service, and training courses and sessions have their own terms agreed at enrollment. Where a course term conflicts with these Terms for a course related purchase, the course term prevails.

1. How ordering works

The shop is a reserve and collect service. You choose items online, pay to reserve them, and collect your order at the academy. Placing an order is an offer to buy. A contract is formed only when we accept your order, which we confirm by email after payment is received.

2. Prices and payment

• All prices are shown at checkout in Malaysian Ringgit (RM) and are the amounts you pay unless an obvious error applies.
• Payment is taken through our payment provider at checkout. Your order is confirmed once payment is received. We do not store your card details.
• Discount codes are subject to their own conditions and may be withdrawn or expire. Only one code applies per order unless we state otherwise.
• If a price is clearly wrong, we may cancel the affected order before collection and refund you in full rather than supply at the mistaken price. We will contact you first.

3. Stock and availability

All items are subject to availability. Stock counts shown online are our best estimate and can change. If an item you paid for turns out to be unavailable, we will contact you and refund the affected item in full, or offer an alternative where one exists.

4. Collection at the academy

• We do not ship orders. We email you when your order is ready for pickup at the academy.
• Please bring your order reference when you collect. If someone collects on your behalf, they need your order reference.
• We hold paid orders for a reasonable period. If an order stays uncollected, we will try to reach you using the contact details you gave at checkout before we make the stock available again.

5. Cancellations, returns, and refunds

• You can ask to cancel an order before you collect it. Contact us with your order reference and we will arrange a refund of the items not yet handed over.
• If an item is faulty, not as described, or we supplied the wrong item, we will repair, replace, or refund it in line with your rights under Malaysian consumer law. Please bring proof of purchase.
• For reasons of hygiene or safety, some items cannot be returned once used or once a sealed package is opened, except where they are faulty. We will tell you if this applies.
• Approved refunds are made to the original payment method. The time it takes to appear depends on your bank or card issuer.

6. Product information

We describe and photograph products as accurately as we can. Colours and sizing can vary slightly between screens and between production batches. Freediving gear is sporting equipment. Read the manufacturer guidance that comes with it, use it within its limits, and never treat any product as a substitute for proper training and supervision in the water.

7. Your responsibilities

• Give accurate contact and collection details so we can reach you about your order.
• You are responsible for choosing items suitable for your needs. If you are unsure, ask us before you buy.
• You must be at least 18 years old to place an order, or have a parent or legal guardian agree to it on your behalf.

8. Liability

To the maximum extent permitted by law, Swimiss will not be liable for any indirect, incidental, special, or consequential loss arising from a shop purchase. Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under Malaysian law, including your mandatory consumer protection rights.

9. Changes to these Terms

We may update these Terms from time to time. The effective date at the top of this page shows the latest version. The Terms that apply to your purchase are the ones in force when you place your order.

10. Governing law and disputes

These Terms are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute arising from these Terms or a shop purchase, subject to any mandatory consumer protection rights that apply where you live.
